MoneyBall DFS Legality Statement

MoneyBall DFS is a Company operating in the Daily Fantasy Sports space where discussions of appropriate legal regulations are ongoing. Both federal and state laws govern MoneyBall DFS and its Daily Fantasy Sports contests. MoneyBall DFS operates in compliance with federal law, including a statute called the Unlawful Internet Gambling Enforcement Act, or UIGEA, which exempts fantasy sports contests from its regulation. State law regarding DFS contests varies by state, and is currently dynamic, with some states expressly regulating DFS contests while others continue to evaluate the legality of DFS contests and potential regulation of the industry. In some states, the legality of DFS contests has never been questioned. In states where politicians or other officials (and not the legislature) have made statements about the legality of DFS contests, MoneyBall DFS may ask a state's courts to clarify its right to operate. Some state legislatures have already passed laws confirming the legality of DFS contests. Still other legislatures are actively debating and considering laws and regulations. MoneyBall DFS monitors new developments and acts quickly to ensure it is in compliance with the laws in any state where it operates. As any changes in the law take place or regulations are implemented, MoneyBall DFS will take steps to ensure its continued compliance, and changes to this site may take place to reflect any such new laws or regulations.

MoneyBall™ DFS LLC is a DFS and meets the following DFS criteria for most states:

1. The values of all prizes and awards offered to winning game participants in public contests are established and made known to the game participants in advance of the game or contest.

2. All winning outcomes reflect the relative knowledge and skill of the participants and are determined predominantly by accumulated statistical results of the performance of individuals in multiple real-world events.

3. No winning outcome is based on the score, point-spread, or any performance or performances of any single real-world team or any combination of such teams; or solely on any single performance of an individual athlete in any single real- world sporting or other event.

4. In states where it is prohibited, the statistical results of the performance of individuals not based on college or high school sports or on horse racing or greyhound racing.

5. A contestant is not permitted to select an athlete through an automatic draft that does not involve any input or control by the paid fantasy sports game participants or choose preselected teams of athletes.

6. A winning outcome is determined by the accumulated statistical results of fully completed contests or events and not merely a portion of a contest or event, except that a paid fantasy sports game participant may be credited for statistical results accumulated in a suspended or shortened contest or event that has been suspended or shortened on account of weather or other natural or unforeseen event.
